You agree to indemnify, defend, and hold harmless Pigeonfi Inc, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Stimulus Assistant service, your violation of these Terms of Use, your violation of any applicable law or regulation, or your violation of any rights of a third party.
To the fullest extent permitted by applicable law, Pigeonfi Inc and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Stimulus Assistant service, regardless of the theory of liability. In no event shall our total aggregate liability exceed one hundred dollars ($100.00) or the total amount you have paid to access the service in the twelve months preceding the claim, whichever is greater. This limitation applies even if we have been advised of the possibility of such damages.
These Terms are governed by the laws of the State of NJ, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of NJ.
